ECtHR standards and domestic implementation of the right to liberty in courts in Albania

The principles of the right to liberty in the jurisprudence of the European Court of Human Rights (ECtHR)  and Article 5 of European Convention on Human Rights were at the focus of a training organised in Tirana by the project “Strengthening the capacities of the Albanian judiciary to better apply standards on the right to liberty and security”, in co-operation with the School of Magistrates.

This initiative adopted a comprehensive approach by bringing together international expertise and local practice. It enabled judges and prosecutors to consolidate their knowledge of ECtHR standards regarding the application of Article 5 within the Albanian jurisprudence and legal framework.

Participants agreed that clear guidance from established ECtHR jurisprudence is essential for interpreting the nuances of local procedural rules. The group examined key ECtHR decisions, including cases against Albania related to Article 5. They also explored national case-law related to security measures, particularly pre-trial detention. This combined analysis of theory and practice will support a more results-oriented approach to the application of pre-trial detention and alternative measures in the future.

This event is organised in the framework of the project “Strengthening the capacities of the Albanian judiciary to better apply standards on the right to liberty and security”, funded by the Human Rights Trust Fund.
