Support to implementation of the law on the Treatment of Property in Albania

The joint European Union/Council of Europe Action “Supporting effective domestic remedies and facilitating the execution of the European Court of Human Rights' judgements” continues to provide support for the correct implementation of the ECtHR's case law on property issues as well as the effective enforcement of Law no. 133/2015 "On the treatment of property and the completion of the property compensation process".

In this context, on 3 May 2019, an inter-institutional meeting aimed at discussing on a uniformed interpretation and application of the law by the institutions responsible for its implementation. Some of the issues discussed in the activity were: the jurisdiction and the subject matter competence of the appeals courts in the appealed cases following treatment by the Property Treatment Agency, the position of the courts regarding their decision-making after the end of the deadline for treatment of cases by the Agency, etc.

The chairs of the Courts of Appeal, the First Instance Courts of Tirana and Durres, representatives from the State Advocacy Office and the Agency of Property Treatment actively contributed with substantial inputs from their daily practice. They emphasised the high quality of discussions and the necessity of creating similar spaces for dialogue and cooperation between the institutions with the aim of implementing the law, as effectively as possible, in order to solve the issues concerning property and to provide service to the citizens.
