Back Enhancement of the Ukrainian System of the Prosecutorial Career Management in line with the European Standards and Best Practices

A round table to discuss ways of enhancing the Ukrainian system of the prosecutorial career management in line with the European standards and best practices took place in Kyiv on 13 February 2018. Among the 40 participants there were representative of the Ukrainian prosecution service, agencies of the judicial sector, civil society, foreign prosecution services and international organisation. They discussed topics such as fair selection of personnel of highest professionalism and integrity, and merit-based promotion.

Three international consultants of the Council of Europe – Mr Jørgen Steen Sørensen, Parliamentary Ombudsman of Denmark, Mr Cédric Visart de Bocarmé, Director of the Support Service of the Belgian Office of the Prosecutor General and Mr Gatis Doniks, Senior Adviser on Prosecution (Management) – presented the best practices of their countries, including the shift from the knowledge-based approach to the use of comprehensive competency models and position profiles.

Mr Artashes Melikyan, co-secretary of the Council of Europe Consultative Council of European Prosecutors, outlined the role of the Committee in the enhancement of organization and operation of the European prosecution services and identified certain standards related to the prosecutorial career management, such as the use of clear and predictable criteria for the selection, recruitment, promotion and relocation of prosecutors.

The discussion of the national practices allowed the representatives of the Council of Prosecutors of Ukraine and Qualification and Disciplinary Commission of Prosecutors, General Prosecutor’s Office of Ukraine and National Academy of Prosecutors of Ukraine to discuss particular aspects of the on-going establishment of the system of staffing and career management, and the challenges faced in connection to it. As a result, possible next steps to improve the system of selection, recruitment, promotion and relocation in the Ukrainian prosecution service in line with the modern standards and best practices were outlined.

The event was organised by the Council of Europe within the framework of the Project “Continued Support to the Criminal Justice Reform”, funded by the Government of Denmark. The round table made part of the continuous endeavour of the Organisation to facilitate the development of the Ukrainian prosecution service as modern, effective and independent institution. Following this, more activities in the field of prosecutorial career management will be implemented. The planned areas of support include capacity building for the Council of Prosecutors and Qualification and Disciplinary Commission, improvement of the regulatory framework, and enhancement of initial and continuous training.
