Back Better reasoning of civil judgments assured through a tailored training for judges and judicial assistants

The second two-day online training on legal reasoning and legal drafting in civil cases with the consideration of the case-law of European Court of Human Rights and decisions of the Constitutional Court of Bosnia and Herzegovina was organised on 27 and 28 May 2021. The webinar was attended by 25 judges and judicial assistants.

aim of the training is improving the skills in writing judgments, which should be simple and clear without compromising the quality. participants learned from mistakes made in the judgements, with a focus on the need to apply a proper style of writing, language, manner of statement of facts, linking the findings to the applied law. It was also highlighted that the process of arriving at a conclusion with provided sufficient reasons for the decision implies also for the obligations of domestic courts to decide the cases within a reasonable time, as required by Article 6.1 of the European Convention of Human Rights - Right to a Fair Trial.

This activity is organised in cooperation with the Judicial and Prosecutorial Training Centres of Republika Srpska and Federation of Bosnia and Herzegovina within the project: “Initiative for Legal Certainty and Efficient Judiciary in Bosnia and Herzegovina- Phase II”, implemented by the Council of Europe and funded by the Kingdom of Norway.
