Bulgaria: Roundtables and meetings in Sofia on execution of the European Court’s judgments

On 19 and 21 March, the Department for the Execution of Judgments participated in two round tables organised in Sofia on the execution of judgments of the European Court in respect of Bulgaria concerning the failure to prevent deaths of children placed in public care and lack of prompt and effective investigation into these deaths (Nencheva case), and evictions or demolition orders without proportionality assessment (Yordanova and Others group of cases).

During these meetings proposals of legislative and practical measures for the implementation of the above two leading cases were discussed. The measures were formulated in the framework of a project financed by the Norwegian Financial Mechanism and implemented by the Directorate "Procedural Representation of the Republic of Bulgaria before the European Court of Human Rights" at the Ministry of Justice. Their aim is to respond to the Committee of Ministers’ decisions adopted at its Human Rights meetings in September 2021 and September 2022. The Committee will examine these cases again at its Human Rights meetings in September and December 2024.

Various national stakeholders attended the events, including representatives of ministries, State agencies, public prosecution services, domestic courts, the Ombudsperson, and civil society.

On 20 and 22 March, the Department also held several meetings in Sofia with different national authorities and stakeholders to discuss a number of other pending leading cases against Bulgaria. The Department met with the Deputy Minister of Justice, representatives of other relevant ministries, the public prosecution services, domestic courts and experts from the Chief Directorate for Execution of Sentences, as well as with representatives of the Supreme Judicial Council, civil society and the Chamber of Private Bailiffs.
