Second HELP course on Admissibility criteria for Montenegrin lawyers

In the framework of the EU/CoE Horizontal Facility Action “Fighting ill-treatment and impunity and enhancing the application of the ECtHR case-law on national level”, the second training seminar on the implementation of the European Convention on Human Rights (ECHR) at national level: Constitutional complaint and individual application before the European Court of Human Rights (ECtHR) was organised in Budva on 12-13 may 2017.

The event was organised in co-operation with the HELP in the Western Balkans and Turkey project and the Montenegrin Bar Association.

More than 30 lawyers from the Southern region of Montenegro could benefit from an in-depth presentation on the procedural prerequisite and grounds for lodging the constitutional complain and the formal prerequisites for deciding on the merits. On day 2, presentations focused on admissibility criteria in applications submitted to the ECtHR, including Rule 47 of the Rules of the Court.

On that occasion, the HELP course on Admissibility criteria in applications submitted to the ECtHR was presented to the participants. The tutored course will be available in Montenegrin for 6 weeks for the selected participants and will be moderated by two national tutors.

The first training seminar on the implementation of the ECHR was organised in Podgorica on 17-18 March bringing together more than 120 practicing lawyers from the Central region in Montenegro. The third and final training seminar will be organised in the Northern region on 21-22 July 2017.

The HELP course on Admissibility criteria was developed by an international group of experts and it is composed of 5 modules:Admissibility:

- overview and procedures

- grounds for inadmissibility: incompatibility, anonymity, substantially the same, abuse of rights

- grounds for inadmissibility: non-exhaustion of domestic remedies, the six months rule and no significant disadvantage

- grounds for inadmissibility: manifestly ill-founded

- striking out and completing the form

The course is available free of charge in the HELP e-learning platform in English, Albanian, Bosnian, Bulgarian, Czech, Italian, Latvian, Lithuanian, Serbian and Turkish.
