Back Presentation of the draft Analysis on influence of the Constitutional Court’s decisions on the work of regular courts

On 4 July 2018 the draft Analysis on influence of the Constitutional Court’s decisions on the work of regular courts was presented to the judges and advisers of the Constitutional and Supreme courts.

The report assessed to which extent the decisions of the Constitutional Court are influencing the case law of Supreme Court and other regular courts in Montenegro. At the same time, it identified the areas where additional efforts are needed to ensure an harmonised implementation of the Strasbourg Convention standards at the national level through reinforced inter-judicial dialogue.

Following the expert mission, the Analysis will be finalised and further steps will be taken to implement the provided recommendations.

The activity is organised in the framework of the Council of Europe Action entitled “Fighting ill treatment and impunity and enhancing the application of the European human rights case law on national level” which is being implemented in Montenegro under the joint Council of Europe and the European Union programme “Horizontal Facility for Western Balkans and Turkey”.
