Publication of a Study on national climate litigation prepared by legal experts under the supervision of the CDCJ

The European Committee on Legal Co-operation (CDCJ) is publishing today a comprehensive study on national climate litigation in Europe, prepared under its supervision by Dr Joana Setzer and Ms Catherine Higham of the Grantham Research Institute on Climate Change and the Environment (London School of Economics and Political Science). The study examines evolving legal cases related to climate change across Council of Europe member states.

It highlights an increase in lawsuits challenging government climate policies and actions, as well as a rising trend in cases against corporations for climate-related harms. The study covers cases involving human rights, compliance with climate frameworks, financial liability for emissions, and adaptation to climate risks.

The Study on national climate litigation offers a relevant source of information for policymakers and practitioners, and brings to light the growing role of national courts in strengthening climate governance and accountability.
