Indietro No. 267/2026 Inclusion Europe v. Czech Republic

The Complaint was registered on 24 August 2026. It relates to Articles 11§1 (the right to protection of health), 14§1 (the right to benefit from social welfare services), and 16 (the right of the family to social, legal and economic protection) of the 1961 Charter, read in light of the non-discrimination clause established in the preamble to the 1961 Charter.

In particular, Inclusion Europe alleges that the City of Prague, a self-governing region, continues to maintain a system of spatial and territorial segregation by commissioning and providing residential social care services outside Prague for its residents with disabilities, especially those with intellectual disabilities, thereby significantly weakening family and community ties and reinforcing disability-based exclusion. At the same time, the complainant organisation contends that the City of Prague has failed to develop an adequate network of community-based social care services within its territory. Accordingly, the complainant organisation submits that the Czech Republic has failed to adopt and implement effective desegregation and deinstitutionalisation strategies. It has also failed to establish a regulatory framework for recognising, preventing and remedying the segregation of people with disabilities, in violation of the aforementioned provisions of the 1961 Charter.
