• International Federation of Associations of the Elderly (FIAPA) v. France, Complaint No. 210/2021 (French only – translation in progress)

The complaint was registered on 28 April 2022. It concerns Articles 5 (the right to organise), 23 (the right of the elderly to social protection) and E (non-discrimination) of the revised European Social Charter. FIAPA alleges that Article L1425-8 of the Public Health Code enacted by Law No. 2019-774 of 24 July 2019, which re-establishes an age limit of 71 years for candidates for an election to the board of the Order of health-care professionals, is in breach with the above-mentioned provisions of the Charter.

• Syndicat des Agrégés de l’Enseignement Supérieur (SAGES) v. France, Complaint No. 211/2021 (French only – translation in progress)

The complaint was registered on 2 May 2022. It concerns Articles 22 (the right to take part in the determination and improvement of the working conditions and working environment), 10 (the right to vocational training) and E (non-discrimination) of the revised European Social Charter. SAGES alleges that French regulations deprive certain associate or contractual higher education teaching staff of representation within the National Council for Higher Education and Research (CNESER), ruling on appeals and in final instance on disciplinary decisions, and allow this staff to be excluded from the jurisdiction of this collegiate body in violation of the above-mentioned provisions of the Charter.
