Back Towards strengthening enforcement mechanisms for Constitutional justice

The Constitutional Court of Montenegro plays an essential role in protecting human rights and freedoms at the national level. Therefore, it is important to enhance the effectiveness of the Constitutional Court enforcement mechanisms.

Building upon the success of the previous activities in reinforcing inter-judicial cooperation, the Action will develop an Analysis of the legislative practices concerning the legal effects of the Constitutional Court’s decisions. The Analysis will address the problems of legal uncertainty and the right to a final judgment, and will provide recommendations for legislative interventions with the aim of ensuring the effective execution of the Constitutional Court decisions.

In the given context, the first expert mission took place on 8 November 2018 during which meetings with the President of the Constitutional Court of Montenegro and his associates were organised. The Analysis will be finalised by the end of February 2019 and further steps will be taken to implement the provided recommendations.

The activity is organised within the framework of the Council of Europe Action entitled “Fighting ill treatment and impunity and enhancing the application of the European human rights case law on national level” which is being implemented in Montenegro under the joint Council of Europe and the European Union programme “Horizontal Facility for Western Balkans and Turkey”.
