Back Exchange of views on national redress mechanisms for damage caused by the aggression of the Russian Federation against Ukraine

Meetings between the Council of Europe, international organisations and Ukrainian authorities on domestic redress mechanisms for damage caused by the aggression of the Russian Federation against Ukraine, were held in Strasbourg in a hybrid format on 19 June 2023.

These meetings aimed at clarifying categories and definitions of damages and victims, mapping of the national legal and policy framework on war-affected people rights and compensation for damage in Ukraine, identifying potential gaps and challenges in order to facilitate the upcoming work of the Register of damage caused by the aggression of the Russian Federation against Ukraine and other planned actions in this area.

The discussions emphasized the need to ensure coherence of actions of all interested parties, including international organisations and the Ukrainian authorities, for proper registration process of the damage caused by the aggression and having efficient compensation mechanism and remedies. They also pointed to the importance of having a coherent vision, a coordinated approach and an efficient communication between all actors involved in this process.

The meetings gathered a wide spectrum of relevant international organisations (IOM, UNHCR, EU project “Pravo-Justice”, EUAM, Atrocity Crimes Advisory Group (ACA) for Ukraine, USAID), international experts and Ukrainian national authorities, including the Ministries of Justice, Social Policy, Community Development, Territories and Infrastructure, Culture and Information Policy, Environment, Veterans affairs, General Prosecutor’s Office, Parliamentary Committee on Legal Policy, Supreme Court, Ombudsperson’s Office and the Office of the President of Ukraine.

The meetings were organised in the framework of the Council of Europe Projects “Judicial and non-judicial remedies for the human rights protection of the war-affected people in Ukraine” and “Support to the functioning of justice in the war and post-war context in Ukraine” implemented through the Council of Europe Action Plan for Ukraine “Resilience, Recover and Reconstruction” for 2023-2026.
