Visit to Malta on the execution of the European Court's judgments

On 20 and 21 March, the Department for the Execution of Judgments carried out a mission to Valletta, organised in cooperation with the State Advocate of Malta.

The Department’s delegation held detailed discussions with representatives from the Ministries for Justice and Reform of the Construction Sector, for Social and Affordable Accommodation, and for Home Affairs; the Correctional Service Agency; the International Protection Agency; the Detention Services Agency; the Agency for the Welfare of Asylum Seekers and the Ambassador for Migration. Further, an exchange of views took place with judges from the Constitutional Court on the status of execution in the pending cases, both under enhanced and standard supervision.

The discussions touched upon short-term and long-term perspectives for the execution of the Court’s judgments concerning the rent control legislation related to requisitioned properties and indefinite extension of private leases (Apap Bologna and Amato Gauci v. Malta groups), to issues of immigration and asylum (Feilazoo v. Malta and S.H. v. Malta), to excessive length of proceedings (Galea and Pavia v. Malta group), and to the development of an effective remedy for inadequate conditions of detention (Abdilla v. Malta).
