Serbia: Roundtable on Convention standards concerning pre-trial detention

On 2 June, the Department for the Execution of Judgments participated in a roundtable held in Belgrade on the application of the legal standards established by the European Court of Human Rights for cases concerning pre-trial detention.

The event brought together 85 participants, including nine judges of the Constitutional Court and its President, as well as judges of the Supreme Court, members of the High Prosecutorial Council, judges of regular courts, prosecutors, court advisors, representatives of the Ministry of Justice and the Judicial Academy, the Agent of the Republic of Serbia before the European Court of Human Rights, as well as a senior legal advisor from the Registry of the European Court.

The Department contributed to the discussions focused on the execution of general measures in the Radonjić and Romić group of judgments against Serbia. These cases concern violations of the right to liberty, including insufficient reasons by courts when ordering pre-trial detention (violation of Article 5 § 3), delays by the Constitutional Court when deciding on detention complaints (violation of Article 5 § 4), and the failure to award compensation for these violations (violation of Article 5 § 5).

This activity was conducted under the joint European Union and Council of Europe programme “Horizontal Facility for the Western Balkans and Türkiye”, and its action “Strengthening human rights protection in Serbia”, in close co-operation with the Constitutional Court of Serbia.
