Romania: Constitutional Court  rules unconstitutional civil code provisions concerning persons with psychosocial disabilities

On 16 July, the Constitutional Court of Romania ruled unconstitutional Article 164, paragraph 1, of the  Civil Code, which enables courts to assign incapacity to  adults with psychosocial and intellectual disabilities.

The Committee of Ministers has expressed serious concerns about these provisions and has consistently underlined the need for Romania to fully safeguard the human rights of persons with psychosocial or intellectual disabilities.  The Committee  supervises the adoption by Romania of measures in this field  in the context of the case of Centre of Legal Resources on behalf of Valentin Câmpeanu v. Romania.
