Applying the European Court of Human Rights jurisprudence to balance human rights and public interest with the need for effective investigation of corruption and organised crime

Two consecutive trainings on application of the European Court of Human Rights jurisprudence relevant to the investigation of high-level corruption, money laundering and terrorist financing cases were organised on 24 and 25 February 2025 by the EU and Council of Europe Action against Economic Crime in Albania in co-operation with the Albanian School of Magistrates. 

These trainings were actively attended on the first day by thirty-five (35) prosecutors and judges of the general jurisdiction, and on the second day, by twenty-five (25) prosecutors and judges of the Special Prosecution Office against Corruption and Organised Crime, first instance Court and Court of Appeal against Corruption and Organised Crime. 

The primary focus of these trainings was to enhance the participants’ understanding and practical application of the European Court of Human Rights jurisprudence within the Albanian justice system, particularly concerning Articles 5 on the right to liberty and security, Article 8 on the right to private and family life, and Article 1 of Protocol 1 to the European Convention on Human Rights on the right to property. The training covered topics of current interest related to the challenges of balancing respect for human rights and public interest with the need for effective investigations. It focused on asset investigations, security measures, preventive seizure and confiscation, as well as the admissibility and use of evidence derived from special investigative measures.

Judges and prosecutors engaged in an in-depth dialogue on the Court’s functioning, decision-making processes, types of rulings, and various knowledge-sharing platforms with the Judge of the European Court of Human Rights, Mr. Darian Pavli, elected in respect of Albania along with other representatives of the Court’s Registry. These trainings provided participants with valuable insights into the reasoning behind the Court’s decisions, ensuring a more informed and effective application of its standards in addressing complex cases of corruption and organised crime. 

This activity was organised by the Action against Economic Crime in Albania, as part of the European Union/Council of Europe joint Programme Horizontal Facility for the Western Balkans and Türkiye.
