Council of Europe has reviewed the implementation of Law No. 3/2016 on the Prosecution

The Council of Europe has conducted a review of the implementation of Law No. 3/2016 on the Prosecution and its compliance with relevant international and European standards. The review was conducted at the request of the General Prosecutor’s Office of the Republic of Moldova.

The review concludes that the existing legislative framework is largely aligned with relevant standards. However, it also highlights several areas requiring clearer regulation and more consistent implementation. These include, inter alia, the organisation of territorial prosecution offices; the role of prosecutors in relation to other branches of government; career development and promotion procedures; disciplinary accountability mechanisms; and the composition and functioning of the Superior Council of Prosecutors.

The review further highlights the need for continued reform efforts in the context of the EU Accession Roadmap. In this regard, it recommends a combination of targeted legislative amendments and strengthened enforcement practices to ensure the effective and sustainable implementation of the legal framework.

The review has been conducted within the framework of the Council of Europe Project “Strengthening the human rights compliant criminal justice system in the Republic of Moldova phase II”, which is part of the Council of Europe Action Plan for the Republic of Moldova for 2025-2028.
