Working Group meeting on the draft CCPE Opinion No. 16 (2021)

The CCPE Working Group met online from 17 to 18 June 2021 to work on the text of its draft Opinion No. 16 (2021) on the implications of decisions of international courts and treaty bodies for practical independence of prosecutors. The text under review was prepared on the basis of contributions from Mr João Manuel da Silva Miguel (Portugal), Mr Jose Manuel Santos Pais (Portugal), and Ms Jana Zezulova (Czech Republic) assisted by the Secretariat. The Working Group discussed the elements of the draft opinion, taking into account the relevant judgments of the European Court of Human Rights and other international courts, as well as observations of treaty monitoring bodies referring to the independence of prosecutors. The Group members stressed the need to further indicate the positive aspects of the case law for reinforcing the practical independence of prosecutors in member States. At the same time, the value of the “soft law” standards developed by the CCPE for the case law was also noted, taking into account the references made by the European Court of Human Rights in its judgments to some of the CCPE Opinions.
