UPAC Project aimed at strengthening
Ukrainian institutions’ capacities
in their anti-corruption efforts.
The project was jointly funded by the
European Commission and the Council
of Europe. It started on 8 June 2006
and lasted until December 2010. Activities Final Conference: Introducing European Anti-corruption Standards (9 December 2009, Kyiv) [16 December 2009, Strasbourg] The final conference of the project gathered representatives of the Ukrainian partner institutions (including Ministry of Justice, Government Agent for anti-corruption policy, Parliament) as well as of the European Union Delegation in Ukraine and the Council of Europe Secretariat. The project beneficiaries highly evaluated the project results.
UPAC organised four more regional seminars on the anti-corruption package of laws (November 2009) [27 November 2009, Strasbourg] These seminars took place in Kharkiv on 12-13 November and Odessa on 24-25 November. Two seminars for prosecutors (12 and 24 November) were co-organised with the General Prosecutor's Office and the Academy of Prokuratura, while two other seminars for judges (13 and 25 November) were held together with the Council of Judges of Ukraine and the Appellate Courts of Kharkiv and Odessa regions.These events, moderated by leading Ukrainian legal experts (from the Supreme Court and the National Academy of Prokuratura) aimed at awareness raising among judicial authorities on the novelties in the new anti-corruption legislation .
Similar regional seminars for
prosecutors and judges were held
in Simferopol and Zaporizhia
and are planned to
take place also in Lviv and Kyiv. Series of regional seminars on the new anti-corruption legislation (October-November 2009) [5 November 2009, Strasbourg] These seminars were organised in cooperation with the Kharkiv Institute of Applied Humanitarian Research and the Ministry of Justice. in addition to four seminars held before - two in Simferopol (22-23 October) and two in Zaporizhia (28-29 October). These events, moderated by leading Ukrainian legal experts (incl. experts from the Supreme Court and the National Academy of Prokuratura) contributed to raise awareness on recently adopted anti-corruption package of laws. Similar regional seminars are planned in Kharkiv, Odesa, Lviv and Kyiv.Training on detection and investigation of corruption and money laundering offences (21-25 September 2009, Lviv) [15 October 2009, Strasbourg] The UPAC project organised a pilot (model) training on detection and investigation of corruption and money laundering related offences. This 5 days training was prepared and delivered by the experts of the International Centre for Asset Recovery of Basel Institute of Governance. It gathered more than 20 agents of the State Committee for Financial Monitoring and General Prokuratura from 7 regions of Western Ukraine and Kyiv.Designed as a case study, the training covered the detection and investigation stages in line with international standards and best practices, GRECO and MONEYVAL recommendations and Ukrainian legislative framework (including changes introduced by the anti-corruption package of laws).
Results of system study on corruption risks (26 June 2009, Kyiv) [20 June 2009, Strasbourg] The results of the system study on corruption risks within the criminal (pre-trial and trial stages), civil, administrative and commercial proceedings in Ukraine were presented during a round table followed by a press conference. This study aimed at supporting the enhancement of the preventive capacities against corruption in the judiciary and the bodies in charge of investigation and prosecution of criminal cases in Ukraine and at formulating recommendations to support current reforms of the judiciary and criminal justice system.
Steering Committee Meeting (25 June 2009) [25 June 2009, Strasbourg] The 7th Steering Committee Meeting of the UPAC project gathered representatives of the partner institutions, the European Commission and the Council of Europe. The participants were expected to assess the project's achievements since February 2009, review the UPAC workplan of activities according to the priorities and needs of the beneficiaries and agree on details regarding the activities to be implemented until the end of the project. The UPAC project, which was initially planned to last until 7 June 2009, has been extended until the end of December 2009.
Mission of the President of the Council of Europe Group of States Against Corruption - GRECO(2-3 June 2009, Kyiv) [16 June 2009, Strasbourg] Mr Drago Kos, President of GRECO, carried out a two-days mission in Ukraine aimed at supporting the strengthening of the national anti-corruption legislative framework and policy in line with GRECO recommendations, international and European standards. In this respect, the President of GRECO met with the Government Agent for Anti-corruption policy as well as representatives of the Ukrainian parliamentary factions to discuss the reform of the anti-corruption policy and legislation, in particular the adoption by the Parliament of the anti-corruption package of laws.Adoption of the "Anti-Corruption package of laws" by the Verkhovna Rada (11 June 2009, Kyiv) [16 June 2009, Strasbourg] The Verkhovna Rada of Ukraine (Parliament) adopted in 2nd reading the "Anti-Corruption package of laws" proposed by the President of Ukraine. The so-called "Anti-corruption package" consists of the three following laws: Law on the Principles of Prevention and Counteraction of Corruption, Law on the Responsibility of Legal Persons for Corruption Offences and the Law on Amending Certain Legal Acts Regarding Responsibility for Corruption Offences. The project has continuously supported the Parliament in the preparation of the package by delivering expert opinions, co-sponsoring parliamentary hearings on these texts.Results of the system study on corruption risks (16 June 2009, Kyiv) [16 June 2009, Strasbourg] A system study on corruption risks within the Public Administration and in particular, the fields of administrative services, control and supervision has been conducted since December 2008. It aimed at supporting the enhancement of the preventive capacities against corruption in the public administration and at formulating recommendations to support current reform of this sector in Ukraine. The results of the system study were announced during a round table followed by a press conference on 16 June.
Roundtable on Identification of Corruption Risks (27 April 2009, Kyiv) [23 April 2009, Strasbourg] The UPAC project, in cooperation with the French Embassy in Ukraine and the Ministry of Justice of Ukraine, hold a roundtable discussion concerning the identification of corruption risks. In this perspective, French experts and representatives of Ukrainian NGOs shared their experiences in identifying and assessing corruption risks as well as in defining appropriate methodologies to be applied in Ukraine.
Training on Detection and Investigation of Corruption
Offences (22-23 April 2009, Kyiv) Roundtable on public ethics and conflicts of interest (26 March 2009, Kyiv) [25 March 2009, Strasbourg] The UPAC project and the Main Civil Service Department of Ukraine, in cooperation with SIGMA programme, held a round table discussion on elaboration of legal provisions regulating public ethics and conflicts of interest.
Videoconference - "Reform of public administration to ensure democratic governance in Ukraine" (25 March 2009, Kyiv) [25 March, Strasbourg] This activity, which was held in a form of videoconference, was organised in cooperation with the National Academy of Public Administration in Kyiv, its regional institutes in four Ukrainian cities and the SIGMA programme ("Support for Improvement in Governance and Management", joint OECD/EU initiative)
Training Seminar on Detection and Investigation of corruption offences (20 March 2009, Kyiv) [19 March, Strasbourg] Within the framework of the UPAC project and in cooperation with the Ministry of Interior of Ukraine, a training seminar on "Detection and Investigation of corruption offences" brought together up to 100 police officers from Kyiv and the regions. The seminar aimed at improving capacities of these personnel in detecting and investigating corruption offences.
Extraordinary Steering Committee Meeting (27 February 2009, Kyiv) [19 February 2009, Strasbourg] The UPAC project gathered the representatives of the partner institutions, the European Commission and the Council of Europe Secretariat for an extraordinary Steering Committee meeting. The participants were expected to review the progress made since November 2008, revised the workplan pursuant to the needs and priorities of the beneficiaries and agreed on details regarding the activities to be organised by June 2009.System Studies on corruption risks [19 February 2009, Strasbourg] In March 2009, two surveys on corruption risks within the public administration (in particular the field of administrative services, control and supervision), in the Judiciary and in the bodies in charge of investigation and prosecution of criminal cases, were conducted throughout Ukraine. These surveys were part of three system studies on corruption risks within the above mentioned sectors, which were conducted by two Ukrainian NGOs since December 2008 until 15 April 2009. The studies were aimed at supporting the enhancement of the preventive capacities against corruption in the public administration, the judiciary and the bodies in charge of investigation and prosecution of criminal cases in Ukraine. Their results and methodologies as well as proposals for improvement will be presented during roundtables foreseen to be held in April-May 2009.
