The Department for the Execution of Judgments of the European Court of Human Rights has published an overview of national provisions on the reopening of domestic judicial proceedings in the context of the execution of judgments and decisions of the European Court of Human Rights in member states of the Council of Europe (see H/Exec(2026)3).
This is the first compilation with such a broad scope, providing a country-by-country summary of the relevant legal provisions and practice in each of the 46 member states, along with references for further research. It may be useful to judges, prosecutors, policy makers, applicants, civil society, national human rights institutions, academics and researchers. It will be regularly updated as and when there are relevant developments in member states.
The document was prepared jointly with the Registry of the European Court. It is a concrete example of work, launched as part of the institutional dialogue between the European Court and the Committee of Ministers on general issues related to the execution of judgments, as called for by the Heads of State and Government in the 2023 Reykjavík Declaration. All member states were consulted prior to publication, through the Execution Coordinators Network, a cooperation network of national coordinators for the execution of judgments of the European Court established in 2024.
