Meeting with the Advisory Council of the Government Agent of the Republic of Moldova

On 20 February, the Department for the Execution of Judgments of the European Court of Human Rights participated in the eighth meeting of the Advisory Council of the Government Agent in Chișinău.

The Department presented a comparative analysis of domestic remedies for compensation for unlawful detention in Council of Europe member states in the context of the authorities’ intention to adopt a new compensatory remedy in respect of, among other things, unlawful deprivation of liberty, an issue examined in the Sarban group.

The Advisory Council further discussed the findings of the 2022–2023 research report, conducted by Council of Europe experts, which analysed the quality of judicial reasoning in decisions concerning pre-trial detention and house arrest in the Republic of Moldova. The use of non-custodial alternatives to detention was examined in light of the systemic obstacles limiting their effective application. Finally, discussions continued on the independence of investigating judges, in particular the influence of public opinion and political discourse on their decision-making.

The meeting was organised with the support of the Council of Europe project “Strengthening the human rights-based criminal justice system in the Republic of Moldova (Phase II)”.
