1995 Additional Protocol providing for a system of Collective complaints: ratified on 04/04/2012.

1996 Revised European Social Charter: signed on 04/11/2000, not ratified yet.

Article 10 of the Constitution: “The ratified and promulgated international treaties on human rights and fundamental freedoms, by which Czech Republic is bound, shall be applicable as directly binding regulations having priority before the law.”

Collective complaints procedure

In 1995, Czech Republic accepted the Additional Protocol providing for a system of Collective complaints: ratified on 04/04/2012.

Indietro No. 104/2014 European Roma and Travellers Forum (ERTF) v. Czech Republic

The complaint, registered on 3 March 2014, relates to Article 11 (the right to protection of health) and 16 (right of the family to social, legal and economic protection), alone or in light of the non-discrimination principle stated in the Preamble of the 1961 Charter. The complainant organisation, the ERTF, alleges that, in the Czech Republic, Roma are disproportionately subjected to residential segregation, substandard housing conditions, forced evictions and other systemic violations of the right to adequate housing and the right to health.

The European Committee of Social Rights declared the complaint admissible on 30 June 2014.

The European Committee of Social Rights adopted its decision on the merits on 17 May 2016.

In its decision on the merits, the Committee concludes:

  • Unanimously, that there is a violation of Article 16 of the 1961 Charter on the ground of insufficient access to housing, poor housing conditions and territorial segregation;
  • Unanimously, that there is a violation of Article 16 of the 1961 Charter on the ground of forced evictions;
  • Unanimously, that there is a violation of Article 11 of the 1961 Charter on the grounds of exclusion in the field of health and inadequate access to health care services;
  • Unanimously, that there is no violation of Article 11 of the 1961 Charter on the grounds of segregation of Roma children.

The Committee of Ministers adopted Resolution Res/CM ChS (2017)2 on 28 February 2017.
