Indietro No. 250/2025 Unión General de Trabajadores (UGT) v. Spain

The complaint was registered on 31 July 2025. It relates to Articles 1§§2 and 4 (the right to work), 3 (the right to safe and healthy working conditions), 11 (the right to protection of health), 16 (the right of the family to social, legal and economic protection), 17 (the right of children and young persons to social, legal and economic protection), 19§1 (the right of migrant workers and their families to protection and assistance), 20 (the right to equal opportunities and equal treatment in employment and occupation without sex discrimination), 26 (the right to dignity at work), 27 (the right of workers with family responsibilities to equal opportunities and equal treatment), 30 (the right to protection against poverty and social exclusion) and 31 (the right to housing) as well as Article E (non-discrimination) read in conjunction with Articles 1§2, 3, 11, 16, 20, 30 and 31 of the revised European Social Charter.  UGT alleges that gaps in legislation and practice regarding prostitution and trafficking in Spain lead to a serious lack of effective protection of women and girls who are victims of prostitution and/or at risk of being trafficked for sexual exploitation, particularly with regard to the most vulnerable groups, such as young immigrant women and youth at risk of social exclusion, in violation of the aforementioned provisions of the Charter.
