New complaint concerning Spain

The complaint was registered on 18 May 2026. It was lodged by the Federación Estatal de Trabajadores de la Administración Pública de la CGT (FETAP-CGT).

The complainant organisation alleges that Spain is not in conformity with Article 1§1 (right to work), Article 20 (right to equal opportunities and equal treatment in matters of employment and occupation without discrimination on the grounds of sex) and Article 24§b (right of workers dismissed without a valid reason to adequate compensation or other appropriate relief) of the European Social Charter.

In particular, the complainant organisation alleges that Spanish legislation does not provide adequate protection against the abuse of successive fixed-term employment relationships in the public sector and fails to guarantee employment stability for public-sector workers employed on a temporary basis. It further alleges that workers concerned do not benefit from adequate compensation or other appropriate relief when their employment is terminated.

The complainant organisation also alleges that the situation gives rise to indirect discrimination on grounds of sex, as women are disproportionately represented among temporary workers in the public sector.
