Back Another step taken towards reinforcement of the judicial dialogue at the national level

Stemming from the conclusions and recommendations provided in the Analysis concerning the legal effects of the Constitutional Court’s decisions, developed under the Action, further steps are taken to reinforce the dialogue between the Constitutional Court and Supreme Court of Montenegro. On 22 April 2019 the Action facilitated a round of talks between the Constitutional Court, Supreme Court and the Government of Montenegro, with the aim to provide solutions and to ensure the respect of the reasonable time standards in the proceedings before the Constitutional Court, in line with European standards.

The discussion focused on the issue of national remedies for acceleration of the proceedings before the Constitutional Court. It was concluded that further legislative interventions are needed to ensure an effective mechanism for the protection of the right to trial within a reasonable time before the Constitutional Court. Further, it was agreed that regular meetings between two courts will be organized with the aim to ensure the harmonized application of the European Court of Human Rights standards at the national level.

The activity is organised within the framework of the Council of Europe Action entitled “Fighting ill treatment and impunity and enhancing the application of the European human rights case law on national level” which is being implemented in Montenegro under the joint Council of Europe and the European Union programme “Horizontal Facility for Western Balkans and Turkey”.
