Report on the needs assessment “Social rights in Ukraine in times of war”

 

The current crisis caused by full-scale Russian Federation’s military aggression against Ukraine should not have as a consequence the reduction of protection of the rights recognised by the European Social Charter, both within Ukraine and beyond its borders. In this context, the Council of Europe prepared the report “Social rights in Ukraine in times of war” within the framework of the project “Continued support to promoting social human rights in Ukraine”.

The report seeks to identify the key areas in which the Council of Europe standards with regard to social rights can contribute to strengthening the economy of Ukraine and ensure it is placed on the most sustainable path both in times of war and after its end.

It does not offer to cover the full range of social rights guaranteed under the European Social Charter, rather, it highlights those areas in which the legislative reform or other action is imminent or most urgent, recalling the applicable standards and challenges that Ukraine faces. Namely, these are the following areas: the right to housing in times of war in Ukraine, the right to social protection in times of war in Ukraine, the right to equality and protection against discrimination in times of war in Ukraine, employment and labour rights in times of war in Ukraine.

The authors of the report - Monika Smusz-Kulesza, PhD (University of Lodz, Poland), Alla Fedorova,

PhD (Taras Shevchenko National University of Kyiv), Bogdan Moysa, analyst (Ukrainian Human Rights Helsinki Group), provided detailed recommendations based on which the future cooperation between the Council of Europe and Ukraine would focus.

The Council of Europe Project “Continued support to promoting social human rights in Ukraine” is implemented by the Office of the Council of Europe in Ukraine within the framework of the Council of Europe Action Plan for Ukraine for 2018-2022. The project aims to strengthen the sustainability of democracy in Ukraine through the expansion of social rights in accordance with European standards.
