Data Protection and the Right to Privacy in Education and in the face of AI

The introduction of digital tools to classrooms, in particular AI applications, raises several serious concerns with respect to pupils’ right to privacy and data protection.

In November 2022, the Council of Europe published a study entitled Artificial Intelligence and Education, a critical view through the lens of human rights, democracy and the rule of law that identified some of the most pressing challenges posed by deploying AI-based tools in education settings and called for specific actions. Two years earlier, the Council of Europe’s Consultative Committee of the Convention for the protection of Individuals with regard to automatic processing of personal data, Convention 108, issued Guidelines Children’s Data Protection in an Education setting.

This EduTalk aims to contribute to the Council’s work with identifying and addressing risks created by new technologies, in particular AI, being deployed in education settings. The invited speakers will elaborate on their experiences with and approaches to tackling privacy and data protection concerns from three different, but complementary perspectives by discussing the following questions: Do we understand how data protection regulations apply to AI based tools in education? Are we aware of all the risks such tools pose, and do we have legal instruments to address them? How do we build trust in AI-based tools in education settings by involving all key actors: pupils, parents, and teachers?

This event is aimed at researchers, education professionals, data protection and right to privacy organisations, and public authorities in the field of education and those interested in artificial intelligence in education.
