On 17 February 2025 the Services of the Legal and Legislative Adviser at the Presidency of the Government and the Council of Europe held a first working session to finalise the methodology on corruption proofing of legislation.
Corruption proofing of legislation entails the reviewing of draft or enacted legislation to identify and minimise potential corruption risks. This process ensures that laws are free of ambiguities or loopholes that could be exploited for corrupt practices. Anti-corruption screening of regulations therefore helps prevent discretionary interpretation and arbitrary application of laws. This proactive approach increases transparency and accountability in the law-making process, which ultimately reduces opportunities for corruption before they can manifest themselves.
One of the main tasks of the Legal Advisory Service of the Presidency of the Government of Tunisia is to review any piece of legislation before it is enacted by the Assembly of the Representatives of the People. The methodology for the corruption proofing of legislation shall therefore add to their capacities for sound legal drafting that advances integrity.
Once finalised, the methodology will be tested and mainstreamed to some of the main regulation-making bodies in Tunisia.
Council of Europe through its joint EU /Council of Europe Project on Improving Economic Governance by Fighting Corruption in Tunisia (AGELA) is supporting the above-mentioned process.
