Public presentation of the Assessment report on the implementation of the National Human Rights Action Plan (NHRAP) 2004 – 2008 and 2011 – 2014 was organised by the Ministry of Justice of the Republic of Moldova in cooperation with the Council of Europe, within the framework of the Project “Support to a coherent implementation of the European Convention on Human Rights in the Republic of Moldova”.

The event was attended by the representatives of central public authorities, international organisations, which contributed largely to the implementation of the National Human Rights Action Plan (NHRAP) since 2004, and by civil society representatives.

The Assessment report on the implementation of the National Human Rights Action Plan (NHRAP) 2004 – 2008 and 2011 – 2014 was developed in cooperation with the Office of the United Nations High Commissioner for Human Rights (UNHCHR) in Moldova.

Beside the presentation of the findings and conclusions of the evaluation process, the following subjects were discussed: the importance of constant communication between the CPAs and LPAs during the implementation process; the results achieved in view of authorities responsible for implementing the provisions of the Plan; the need for creating a more efficient monitoring mechanism, and improving the reporting process.

In his opening speech, the Minister of Justice, Mr Vladimir Cebotari, has mentioned the large support of Moldova’s development partners at all stages, from developing the NHRAPs through monitoring of its implementation, evaluation of achievements in the human rights field, sharing European standards and best experiences.

The Head of the CoE Office in Chisinau, Mr Jose Luis Herrero, stressed the importance of prioritising the actions and setting clearly defined objectives, with the allocation of appropriate funds, especially given the multitude of instruments in the area of human rights. He also expressed the Council of Europe readiness to continuously support the national authorities in better observing the European and international human rights standards in the Republic of Moldova, as well as offering the Council of Europe expertise in the process of developing the new National Human Rights Action Plan.

Approximately 60% of the actions foreseen by the National Human Rights Action Plan (NHRAP) 2004-2008 were completed and up to 80% of the actions comprised in the NHRAP 2011-2014 were implemented up to date.

However, a number of objectives and actions foreseen by the NHRAP do not have a time limit and shall be implemented continuously. For instance, the harmonisation of national human rights legislation with international standards; observance of obligations assumed under international human rights conventions; observance of patient rights; increasing the quality of education; ensuring the independence of the media etc. Thus, actions partially implemented or not implemented at all need further implementation.

About the Programme

General objective:

developing the capacity of judicial and law enforcement authorities to effectively implement the ECHR and the case law of the European Court of Human Rights (ECtHR).

Total project cost: € 600 000. Duration of the project: 26 months, until February 2016.

Project is guided by three objectives:

  1. To ensure that compliance of national legislation and administrative practice with the ECHR is assessed.
  2. To strengthen human rights guarantees in the criminal procedure and improve its efficiency.
  3. To enhance the institutional capacities for an effective implementation of the ECHR including its case law at national level.

The main issues to be addressed by the project are:

  • compliance of the criminal procedure and other important (draft) legislation with the ECHR and its case law;
  • institutional weakness of the SCJ and other courts as regards interpretation and uniform application of the ECHR and its case law;
  • lack of coherence in the interpretation and application of the national legislation in line with the ECHR and its case law, and, as a consequence, lack of an appropriate level of predictability of the justice system;
  • further need of capacity-building for the national HR training institutions and increasing the pool and qualification of national trainers on the ECHR;
  • the need to further improve the knowledge on the ECHR and its case law among judges and other legal professions.

Expected results:

Consequently, the expected results of the project are:
  • laws and draft legislation which have or might have an effect on the level and efficiency of protection of human rights are assessed by the CoE;
  • the effectiveness and consistency of human rights protection, especially in the context of criminal procedures, are improved in Moldova;
  • the capacity of the SCJ to ensure a harmonised application of the ECHR and in the national jurisprudence is strengthened, in particular through the systematised and regularly updated database of explanatory decisions and recommendations;
  • awareness about the standards of the ECHR is raised and a favourable environment is created for its harmonised implementation by the law enforcement and judicial bodies;
  • the current groups of national trainers on the ECHR for legal professions are reinforced;
  • training materials, including HELP materials, are further developed and made available in Romanian;
  • the level of professional skills and knowledge on ECHR standards among judges and other legal professions is strengthened through the use of the increased availability of trainings and resources (database, handbooks etc.).

Activities and support

Targeted support:

The project will address these problems and achieve the expected results through a combination of targeted support:
  • international expertise to review the relevant legislation and practices of its implementation, identify needs and obstacles in the uniform application of the ECHR and its case law in Moldova and draft recommendations on how to improve this application and how to strengthen the role of the judiciary in this regard,
  • support to raising awareness about the importance of a coherent application of the ECHR and its case law among judges and other legal professions,
  • capacity-building for specialised national training institutions and ECHR trainers, enabling them to better train their peers,
  • enhance training for judges, law enforcement agents and other legal professions to better use the ECHR in their daily work, through multiplying training sessions and involving more national trainers.
