At its Human Rights meeting on 2 to 4 December, the Committee of Ministers welcomed the consolidation of the preventive remedy to effectively address complaints related to overcrowding and material conditions of detention. This progress was achieved through a wide range of measures, including extensive infrastructure works and a shift in penal policy towards rehabilitation and the prevention of reoffending.
The Committee encouraged the authorities to intensify their efforts in adopting and implementing measures to confirm this positive trend, with the aim of definitively resolving the problems in question and guaranteeing each prisoner living conditions compatible with the Convention standards.
The Committee decided to close its supervision of a number of repetitive cases, where the applicants have either been released or transferred to conditions compliant with Article 3 of the Convention, and of the Bragadireanu v. Romania and Marcu v. Romania leading cases. It decided to continue its supervision of the outstanding general measures within the framework of the Rezmiveș and Others pilot judgment.
The Committee’s assessment concerning the preventive remedy was confirmed by the European Court in a decision delivered on 4 December 2025 (Văscăuțanu v. Romania, no. 10120/23).
