Albania advances judicial dialogue and strengthens legal certainty

As part of the continuous efforts to advance judicial dialogue and legal certainty in Albania, 24 judges from the Supreme Court and the Constitutional Court met in Tirana for a joint exchange. Supported by the European Union and Council of Europe, the event aimed to harmonise judicial approaches and ensure more coherent application of European human rights standards in domestic case-law. Judges from the two highest courts in Albania discussed topics of mutual interest, such as the constitutional standards of judicial reasoning and the distinction between insufficient reasoning and legal error. Participants exchanged views on handling legal claims, the courts’ role when decisions appear unfair, and the need for clear and consistent laws and rulings.

This exchange strengthens co-operation between the Supreme Court and the Constitutional Court, in line with the European Convention and the case-law of the European Court in Strasbourg. The meeting marks an important step towards harmonisation of domestic jurisprudence and further aligns Albanian judicial practice with Strasbourg case-law. Both courts agreed on key topics for future co-operation, demonstrating their joint commitment to consistent court decisions, the rule of law, and protecting human rights in Albania.

This activity is organised in the framework of the Action Improving the protection of the right to property and facilitating execution of ECtHR judgments in Albania (D-REX III), part of the European Union and the Council of Europe joint programme Horizontal Facility for the Western Balkans and Türkiye.
