Back No. 253/2025 European Organisation of Military Associations and Trade Unions (EUROMIL) v. France

The complaint was registered on 20 October 2025. It relates to Articles 5 (the right to organise) and 6 (the right to bargain collectively) of the revised European Social Charter.  EUROMIL alleges that Article L4121-4, Article L4126-6 (2), Article R4126-6, and Article R4126-7 of Law No. 2005-1550 of 12 December 2005 amending various provisions relating to defence are not in conformity with Articles 5 and 6 of the Charter. EUROMIL maintains in particular that France prohibits professional military associations from exercising trade union activities, that it fails to promote effective joint consultations and collective agreements, appropriate mechanisms for the settlement of labour disputes, and that it prohibits professional military associations, as workers' organisations, from exercising the right to strike, in violation of the above-mentioned provisions of the Charter.

The European Committee of Social Rights declared the complaint admissible on 16 March 2026.
