Back No. 248/2025 Asociación Profesional Justicia Guardia Civil (JUCIL) v. Spain

The complaint was registered on 3 July 2025. It relates to Articles 5 (the right to organise) and 6§§ 2 and 4 (the right to bargain collectively) of the revised European Social Charter. JUCIL alleges that, pursuant to Organic Law 11/2007 of 22 October 2007, regulating the Rights and Duties of the members of the Spanish Guardia Civil, the latter are deprived of their right to organise, in violation of Article 5 of the Charter. JUCIL also alleges that, as a result of the prohibition of the trade union activities by its members, it does not have the right to participate in consultation processes or of collective bargaining with the public authorities, in violation of Article 6§2 of the Charter. JUCIL further alleges that the prohibition on Spanish Guardia Civil members, along with the rest of the State Security Forces and Corps, from exercising their right to strike is in breach with Article 6§4 of the Charter. Finally, JUCIL asserts that depriving Guardia Civil members of their trade union rights, and the absolute prohibition on them and their associations from exercising the right to collective bargaining and the right to strike is not necessary or proportional within the meaning of Article G of the Charter and that this prohibition is discriminatory with respect to other national or european police corps, public servants and workers of the ordinary legal regime.

The European Committee of Social Rights declared the complaint admissible on 16 March 2026.
