Constitutional Court and Ministry of Justice Meet to Strengthen the Effectiveness of the Individual Application System

A Co-ordination Meeting was held between the Turkish Constitutional Court (TCC) and the Ministry of Justice to strengthen the effectiveness of the individual application system by improving the execution of Constitutional Court judgments.

The meeting brought together senior representatives of the Turkish Constitutional Court, including the Secretary General, Deputy Secretary General, and Chief Rapporteurs, as well as senior officials from the Ministry of Justice's Human Rights Department, including Department Heads and Deputy Heads.

The event opened with a joint session on the working procedures and practices of the TCC and the Human Rights Department of the Ministry of Justice, setting the stage for structured inter-institutional dialogue. Following opening presentations by the Chief Rapporteurs of the TCC and the Deputy Heads of the Human Rights Department, participants gathered in thematic roundtable groups to exchange views and share expertise on key rights areas, including:

  • Right to Life and Prohibition of Ill-Treatment
  • Right to Liberty and Security
  • Right to a Fair Trial (civil, administrative, and criminal aspects)
  • Right to Respect for Private and Family Life
  • Freedom of Expression
  • Right to Property
  • Execution of TCC Judgments

The roundtable format enabled an in-depth exchange between TCC rapporteurs and Ministry of Justice judges on the practical challenges encountered in the execution of TCC judgments, with a particular focus on preventing repetitive human rights violations.

The afternoon session concluded with presentations by representatives summarising the outcomes of each thematic roundtable.

This coordination meeting was the fifth of the working group meetings aiming at building an inter-agency platform to assess the effectiveness of the individual application system through the lens of the execution of TCC judgments and to develop recommendations for various public actors on ways to improve the situation, including through the prevention of repetitive cases.

The Joint Project on “Supporting the Effective Implementation of Turkish Constitutional Court Judgments in the Field of Fundamental Rights” is co-funded by the European Union and the Council of Europe and implemented by the Council of Europe. The Turkish Constitutional Court is the end beneficiary of the Project.
