Ukraine: Roundtable on combating discrimination and ensuring diversity

On 13 February, the Department for the Execution of Judgments virtually participated in the roundtable "Harmonisation of Ukrainian legislation with European standards in the field of combating discrimination and ensuring diversity", held in Kyiv. The event was organised by the Ministry of Foreign Affairs and the Council of Europe Office in Ukraine, with the involvement of multiple national stakeholders, other international organisations and representatives of civil society.

During the session dedicated to international standards on ensuring diversity and combating discrimination, the Department informed the participants about the recent judgment in the case of Maymulakhin and Markiv v. Ukraine, where the Court found a violation of Article 14 of the Convention (prohibition of discrimination), in conjunction with Article 8 (right to respect for private and family life), due to the fact that the applicants, a same-sex couple, were treated differently from different-sex couples on account of the impossibility to register their partnership.

The Committee of Ministers is supervising the execution of this judgment under the enhanced procedure since 1 September 2023, when the judgment became final. The Ukrainian authorities are expected to submit information on the measures taken or envisaged by 1 March 2024.
