Ukraine: Conference on the role of the judiciary in the post-war reconstruction period

On 8 and 9 December, the Department for the Execution of Judgments participated in the International Conference "The Role of the Judiciary in Overcoming the Challenges of War" held in Lviv, Ukraine. The event was organized by the Supreme Court in collaboration with the Ukrainian Catholic University, the Council of Europe and the Organisation for Security and Co-operation in Europe (OSCE).

During the session dedicated to the execution of the European Court’s judgments on the implementation of domestic courts’ decisions concerning social obligations, the Department presented the latest developments in the practice of the Committee of Ministers and underlined the importance of effective cooperation between the legislative, the executive and the judiciary branches of power at the domestic level. The Department also participated in the session on the effective protection of rights of civilians in wartime, including compensation for damages caused by war.

In the margins of the Conference, the Department held bilateral meetings with the President of the Supreme Court, the members of the High Council of Justice, and the Deputy Minister of Social Policy. The parties discussed the developments and challenges related to the execution of judgments supervised by the Committee of Ministers under the enhanced procedure, notably the Burmych / Yuliy Nikolayevych Ivanov group, which concerns the issue of non-enforcement of domestic judicial decisions, and the Oleksandr Volkov group, which concerns the structural independence of the judiciary.
