North Macedonia: assessment of pre-trial detention supporting the execution of the European Court’s judgments

On 15 December, the Department for the Execution of the European Court’s judgments participated in a seminar for the presentation of the assessment of pre-trial detention situation in North Macedonia, organised and funded by the Council of Europe. The assessment, which will be shortly made public, has been developed by the consultant from the non-governmental organisation Coalition All for Fair Trial, supported by the Council of Europe, in cooperation with the Academy for Judges and Public Prosecutors of North Macedonia.

Participants of the seminar that followed the presentation included judges, prosecutors, the Government Agent, lawyers from the European Court’s Registry and the Execution Department as well as experts. The Department presented the outstanding issues in the implementation of the European Court’s judgments in the Vasilkoski and Others group relating to insufficient reasoning of decisions extending pre-trial detention and lack of equality of arms in the proceedings reviewing applicants’ detention.

Moreover, in light of the event's outcomes and the conclusions drawn from the assessment, the Academy of Judges and Public Prosecutors is planning to incorporate training on right to liberty and security aiming to disseminate standards of the European Court in this field as well as to reduce the usage of effective detention vis-à-vis preventive measures.
