Republic of Moldova - Seminar on conditions of detention and effective remedies

The Department for the Execution of Judgments of the European Court of Human Rights participated in the seminar “Implementation of a new domestic remedy to challenge conditions of detention in the Republic of Moldova” held in Chișinău on 25 October 2018.

The seminar was organised in the framework of the Council of Europe Programme “Promoting a human rights compliant criminal justice system in the Republic of Moldova”. Discussions focused on the practical aspects of implementation of the new preventive and compensatory remedies adopted by the Republic of Moldova following the European Court’s judgment in the Shishanov case. Participants discussed measures aimed at ensuring practical effectiveness of the new remedies, their application by investigating judges and administrations of penitentiary institutions.

The Department’s delegation underlined the need to adopt a comprehensive approach to deal with the problem of poor conditions of detention. To this end, cooperation is required among all domestic actors, notably policy makers, prison and probation services, social services, prosecutors and judges. Action of the authorities should aim at eliminating the root causes of the poor material conditions of detention as well as at ensuring the effectiveness of the new remedies.
