The project focus and expected results
  • The Constitutional Court of Ukraine has strengthened its methodological and information-related tools to ensure consistent, rights-compliant constitutional adjudication aligned with European standards.
  • The Secretariat of the Constitutional Court of Ukraine has gained a better understanding as to the improvement of its institutional performance, in line with European practices.
Project objective

The objective of the Project is to further advance the development of constitutional justice in Ukraine by providing advisory and expert support to the Constitutional Court of Ukraine on matters related to institutional development and the implementation of European standards in the field of constitutional adjudication and the protection of human rights.

The Project continues the co-operation with the Constitutional Court of Ukraine initiated under the previous project “Support to development of the constitutional justice in Ukraine”, implemented within the framework of the joint programme of the European Union and the Council of Europe “Partnership for Good Governance”.

Building on the findings and experience gained during the implementation of previous initiatives, the Project will further develop professional dialogue and provide targeted expert support. In particular, this support will be delivered through the conduct of a comprehensive needs assessment aimed at informing the future administrative reform of the Secretariat of the Constitutional Court of Ukraine, as well as through activities supporting the consistent interpretation and application of human rights standards deriving from the European Convention on Human Rights, the case law of the European Court of Human Rights, and the principles developed by the Court of Justice of the European Union.

Project approach and activities

The Project aims to further advance the development of constitutional justice in Ukraine by addressing the priority needs of the Constitutional Court of Ukraine in the areas of institutional development, implementation of European standards, and targeted strengthening of institutional capacity.

The Project will promote deeper professional exchange and provide continued expert support in the process of aligning the activities of the Constitutional Court of Ukraine with European standards. A key component of this phase will be a comprehensive needs assessment aimed at informing the future administrative reform of the Secretariat of the Constitutional Court of Ukraine. This assessment will examine the organisational structure, internal workflows, staff functions, and resource management practices, identifying opportunities for modernisation in line with European models of constitutional court administration.

The implementation of the Project will also contribute to strengthening the capacity of the Constitutional Court of Ukraine for the coherent interpretation and application of human rights standards enshrined in the European Convention on Human Rights, the case law of the European Court of Human Rights, and the principles developed by the Court of Justice of the European Union.

The Project will further maintain structured dialogue with partner courts of the Member States of the European Union in order to facilitate the exchange of experience, enhance institutional resilience, and reinforce the orientation of the Constitutional Court of Ukraine towards high-quality constitutional justice aligned with European standards.

The key stakeholders of the Project include judges, judicial assistants, and staff of the Secretariat of the Constitutional Court of Ukraine, who will directly benefit from targeted assessments, expert support, and strengthened co-operation mechanisms.

The methodology of the Project implementation includes the provision of expert support and the organisation of activities aimed at promoting professional dialogue and strengthening institutional capacity.
