Round table “The principle of legal certainty: standards of the Council of Europe and the practice of Ukrainian courts”

On 30 June 2021, the Council of Europe project “Support for judicial institutions and processes to strengthen access to justice in Ukraine” jointly with the Supreme Court and the National School of Judges of Ukraine organized a round table “The principle of legal certainty: standards of the Council of Europe and the practice of Ukrainian courts”(via videoconference).

Mr Vsevolod Knyazev, Secretary of the Grand Chamber and judge of the Supreme Court, Mrs Natalia Shuklina, Acting Rector of the National School of Judges of Ukraine, and Mrs Iryna Kushnir, Manager of the Council of Europe project “Support for judicial institutions and processes to strengthen access to justice in Ukraine” welcomed the participants of the round table.

The following issues were discussed in the framework of the round table:

  • the standards of the Council of Europe and the respective caselaw of the European Court of Human Rights with regard to the principle of legal certainty;
  • the judicial practice of the Constitutional Court of Ukraine and the Supreme Court with regard to the principle of legal certainty;
  • the application of the principle of legal certainty in the practice of Ukrainian courts and the identification of the most actual issues concerning the application of the principle of legal certainty in the Ukrainian legal system.

The speakers of the round table were:

  • Mrs Ganna Yudkivska, Judge of the European Court of Human Rights
  • Mrs Tetyana Fuley, Head of the Department of researches on problems of legal proceedings and scientific and methodological support of judicial education of the National School of Judges of Ukraine
  • Mr Taras Vavrynchuk, Lawyer of the European Court of Human Rights
  • Mr Dainius Zalimas, International consultant of the Council of Europe, former President of the Constitutional Court of Lithuania (2014-2021)
  • Mr Vasyl Lemak, Judge of the Constitutional Court of Ukraine
  • Mr Vasyl Krat, Judge of the Civil Cassation Court of the Supreme Court
  • Mr Dmytro Tretyakov, Lawyer of the European Court of Human Rights, Deputy Registrar of the Administrative Tribunal of the Council of Europe.
