On December 13, 2021, online consultations on the legal regulation of the status of judicial assistants in Ukraine took place. This event was organized by the Council of Europe Project “Support for judicial institutions and processes to strengthen access to justice in Ukraine” jointly with the Council of Judges of Ukraine. The international expert of the Council of Europe, ex-Deputy Minister of Justice of the Republic of North Macedonia, Mrs. Marina Naumovska-Milevska, is analyzing the legal framework of the status of judicial assistants in Ukraine in compliance with the standards and the best practices of the member states of the Council of Europe. These consultations were organized by an international expert with representatives of the judiciary and judicial self-government bodies, representatives of independent associations of judges and the Association of Assistant of Judges of Ukraine in order to ensure the effectiveness of this analysis and formation of the recommendations for improving national legislation.
Marina Naumovska presented a brief overview of the existing models of the institution of judicial assistants in the member-states of the Council of Europe and noted that there is no unified model, each country chooses the model that suits it better.
The following issues were discussed during the consultations:
- the status, appointment and tenure of judicial assistants;
- the rights and duties of judicial assistants;
- the salaries of judicial assistants, the duration of their holidays and stimulus payments.
Most of the participants during the consultations expressed the opinion that the institution of judicial assistants in Ukraine requires an urgent reform and adequate financial provision.
The international expert will prepare, based on the results of these consultantions, an analysis of the legal regulation of the status of judicial assistants in Ukraine in the light of compliance with the standards of the Council of Europe and considering the best practices of European states.
