On 13 October 2025, a workshop dedicated to the methodology for the uniform application of the law took place with the participation of six judges and fourteen judicial assistants of the Supreme Court of Justice (SCJ) of the Republic of Moldova.
As the highest judicial authority in the country, the SCJ plays a crucial role in ensuring that the law is applied consistently across the judicial system. This mandate was further reinforced by the Law No. 64/2023 on the Supreme Court of Justice, and the Court is now working to develop clear methodologies and tools to effectively fulfil this role.
Opening the event, the Acting President of the Supreme Court of Justice, Ms Stela Procopciuc, underlined the importance of cooperation and shared reflection:
“We wish for this day to be one of open dialogue, exchange of experience, and joint reflection on how the Court can further strengthen its role as a guarantor of legal certainty and a promoter of the right to a fair trial.”
The workshop sessions focused on European approaches to ensuring the uniform application of the law in different legal systems. Participants examined the key reference materials, including CCJE Opinion No. 20, on the role of courts with respect to uniform application of the law, opinions of the Venice Commission, and relevant case-law of the European Court of Human Rights.
Through group discussions, the participants identified a set of practical proposals to inform the drafting of a future methodology for judicial unification, aimed at supporting the SCJ in ensuring a more consistent and effective application of the law and enhancing the coherence and predictability of the judicial system.
This activity was implemented within the framework of the Council of Europe Project “Strengthening the Institutional Capacity of the Supreme Court of Justice”. The Project supports the implementation of the Supreme Court’s reform and aims to enhance its capacity to deliver justice in line with European standards by improving the quality and consistency of judicial decisions and promoting the uniform application of the law.
