Обратно Republic of Moldova: Legislative reform prohibits detention of minors in public custody for migration-related breaches

On 29 April, the Committee of Ministers ended its supervision of the execution of the European Court of Human Rights’ judgment in the case of Minasian and Others v. the Republic of Moldova. This case concerned the detention in public custody of minor children in 2017 without a legal basis, after they attempted to illegally cross the state border with their mother, and their inability to challenge their detention.

The supervision was closed following legislative amendments to Law no. 200 on the regime of aliens, which removed the possibility of placing alien families with minors in public custody for breaches of migration legislation, thereby preventing similar situations from arising in the future.
