Council of Europe supports discussions on current issues of criminal procedural legislation through the prism of the decisions of the Constitutional Court of Ukraine

A two-day round table on “Current issues of criminal procedural legislation through the prism of the decisions of the Constitutional Court of Ukraine” was organised with the support of the Council of Europe project “Further support to the Constitutional justice reforms in Ukraine”.

The event brought together judges of the Constitutional Court of Ukraine, judges of the Criminal Cassation Court within the Supreme Court, judges of the Grand Chamber of the Supreme Court, and heads of Ukrainian courts of appeal. The discussions addressed the role of the decisions and legal positions of the Constitutional Court of Ukraine in the interpretation, application and further development of criminal procedural legislation, as well as their importance for safeguarding constitutional guarantees of human rights, the rule of law and consistency of judicial practice.

During the round table, participants discussed the constitutionalisation of criminal justice, the interconnection between constitutional review and criminal justice, as well as issues related to access to criminal justice. Particular attention was paid to the temporal aspects of the decisions of the Constitutional Court of Ukraine and national courts, the practice of the Criminal Cassation Court through the prism of constitutional guarantees of human rights, and the impact of the decisions of the Constitutional Court of Ukraine on the practice of the Grand Chamber of the Supreme Court. Participants also considered the relevance of the legal positions of the Court of Justice of the European Union and the European Court of Human Rights for the practice of the Constitutional Court of Ukraine.

The round table provided a platform for professional inter-institutional exchange on the application of criminal procedural legislation, taking into account the decisions of the Constitutional Court of Ukraine. This dialogue contributes to the development of consistent approaches in judicial practice, strengthens legal certainty and supports the effective protection of constitutional guarantees of human rights in the field of criminal justice, in line with Council of Europe standards.
