With the aim to strengthen enforcement mechanisms for Constitutional Law, the Action has developed the Analysis of the legislative practices concerning the legal effects of the Constitutional Court’s decisions, addressing the problems of legal uncertainty and the right to a final judgment.

On 26 and 27 February 2019 the analysis was presented to the representatives of the Constitutional Court, Supreme Court and Government of Montenegro. Building upon the success of previous activities in reinforcing inter-judicial cooperation, recommendations for legislative improvements are provided with the aim of ensuring an effective execution of the Constitutional Court decisions. Further steps will be taken under the Action to implement the provided recommendations.

The activity is organised within the framework of the Council of Europe Action entitled “Fighting ill treatment and impunity and enhancing the application of the European human rights case law on national level” which is being implemented in Montenegro under the joint Council of Europe and the European Union programme “Horizontal Facility for Western Balkans and Turkey”.
