Back Romania: removals of senior prosecutors are now subject to judicial review and freedom of expression is reinforced

At its Human Rights meeting held on 5-7 June the Committee of Ministers ended its supervision of the execution of the ECHR judgment in the case of Kövesi. This case concerned violations of the Convention due to the lack of judicial review concerning the premature termination of the applicant’s mandate as Chief Prosecutor of the National Anticorruption Directorate, after her expression of views on legislative reforms and the fight against corruption. The applicant now serves as European Public Prosecutor.

The authorities took action to implement the ECHR judgment in the framework of a broader judicial reform, which took effect in December 2022. The new legislation gives full jurisdiction to the High Court of Cassation and Justice to review, under an emergency procedure, the legality and the merits of decisions to remove from office senior officeholders in the State Prosecution Service. Also, Parliament abolished legislative provisions which had unduly restricted the freedom of expression of judges and prosecutors vis-à-vis the other branches of government.
