CDCJ finalises draft Recommendation on the nationality of children

The CDCJ’s Limited Working Group on Migration (CDCJ-MIG) held its 6th and final meeting online on 22–23 September. The Group finalised the draft revised Recommendation on the nationality of children, together with its draft explanatory memorandum and a draft checklist for policymakers.

This legal instrument contributes to the Council of Europe Strategy for the Rights of the Child (2022–2027) and to the Global Alliance to End Statelessness, launched by UNHCR in 2024. It provides guidance on safeguarding children’s rights in proceedings affecting their access to nationality, including statelessness determination procedures, and on birth registration as a means of ensuring children can access their rights.

The CDCJ will consider the draft Recommendation for approval at its 107th plenary meeting, to be held on 17–19 November 2026. It will then be submitted to the Committee of Ministers for adoption.
