The Council of Europe HELP tutored course “Personal Data Protection in the Publication of Judicial Decisions” was launched for 36 judges and court staff on 17th March in Kyiv. The course aims at strengthening professional capacity of representatives of the judiciary to ensure an appropriate balance between the principle of open justice and access to public information and the personal data protection in publication of court decisions.
Discussions addressed key challenges in personal data protection, the impact of digitalisation and the use of artificial intelligence in the administration of justice, as well as the role of national and European standards in safeguarding the right to privacy. Invited speakers highlighted issues such as safeguarding privacy in AI-driven judicial processes, openness of courts’ decisions, and recent developments in Ukrainian legislation, in particular:
- Ensuring the Right to Privacy in the Context of AI Integration into Justice was presented by Jan Bernaziuk, Judge of the Supreme Court (Administrative Cassation Court);
- Current challenges for human rights and ensuring the openness of courts` decisions and the protection of personal data in the activities of judicial authorities, presented by Tetiana Oleksiiuk, consultant of the Council of Europe Project “Support to the Implementation of the European Human Rights Standards in Ukraine: Phase II”;
- The current trends in development of legislation and activities of the Ukrainian Parliament Commissioner for Human Rights in the context of oversight of compliance with personal data protection legislation presented by Yuliia Derkachenko, Representative for Information Rights of the Ukrainian Parliament Commissioner for Human Rights and Yehor Yahmurov, Head of the Sector for Implementation of International Standards in the Field of Information Rights, Secretariat of the Ukrainian Parliament Commissioner for Human Rights
- Personal data protection as the European standard shaping the future on Ukraine’s Path to EU Integration was presented by Iryna Kushnir, Project Manager, Council of Europe Project “Supporting the Judiciary of Ukraine during the War and the Post-War Period”
The Council of Europe HELP course “Personal Data Protection in the Publication of Judicial Decisions” (2 hours of e-learning) is also available in self-learning format. It aims to present the importance of data protection in publication of judicial decisions, what is personal data and how to collect, use and protect them through various mechanisms and instruments. The completion of this course seeks to validate several learning objectives from the ability to draft or review judgements in a data protection compliant way to knowing the available procedural and operational level remedies and how to apply them.
Upon completion, users can generate their electronic Statements of Accomplishment, in proof of their acquired knowledge and skills.
The launch was organised within two Council of Europe Projects “HELP (Human Rights Education for Legal Professionals) for Ukraine, including during wartime”, Phase II and “Support to the Implementation of the European Human Rights Standards in Ukraine: Phase II” in cooperation with the National School of Judges of Ukraine.
