Judges, academicians, arbitrators of internal and external arbitration institutions discussed the reform of arbitration in Ukraine  on 23 January 2017 in Kyiv

On 23 January 2017, an expert discussion on the reform of arbitration institutions in Ukraine took place in Kyiv. The event was organized by the Council of Europe project “Support to the implementation of the judicial reform in Ukraine” jointly with the Committee of the Verkhovna Rada of Ukraine on Legal Policies and Justice, the High Commercial Court of Ukraine and the Arbitration Chamber of Ukraine.

The event discussed issues of functioning of arbitration institutions in Europe and in Ukraine, an interaction between arbitration institutions and the judiciary, as well as approaches towards the reform of arbitration institutions in Ukraine.

While exchanging views on the agenda, the participants of the expert discussion agreed that the reform of arbitration institutions in Ukraine should consist of:

  1. Ensuring pro-arbitration climate in the country;
  2. Support by the judiciary in development of arbitrage;
  3. Improvement of the legislation concerning arbitration.

Mr Taras Shepel, Head of Arbitration Chamber of Ukraine, Head of Arbitration Court of the Ukrainian National Committee of the International Chamber of Commerce presented a concept on the reform and development of arbitration institutions of Ukraine.

Following the discussion at the event, the concept will be updated based on recommendations and reservations advanced by the participants and the final text will be publicised together with the working materials of the event.

The event was attended by judges of the High Commercial Court of Ukraine, appellate commercial courts of Ukraine, arbitrators of internal and external arbitration institutions, as well as by the Council of Europe experts Dr. Moritz Keller, counsel in the international arbitration practice, «Freshfields Bruckhaus Deringer LLP» (Vienna), expert in commercial and treaty arbitration proceedings; Mr Eliseo Castineira, founder of international arbitration boutique law firm “Castineira” (Paris), expert in arbitration and alternative dispute resolution, director of the French Association for Arbitration; Mr Rupert D’Cruz, barrister, lawyer at the «Littleton» law firm, expert in commercial and chancery litigation and international arbitration.   

The Council of Europe project “Support to the Implementation of the Judicial Reform in Ukraine” is funded by a contribution from the Government of the United Kingdom of Great Britain and Northern Ireland. It aims at further approximation of Ukrainian system of judiciary to the standards and recommendations of the Council of Europe.
