Kosovo*- Enhancing Judicial Protection of Human Rights
The main objective of the project is to enhance the protection of human rights in Kosovo*, by improving the quality of applications lodged with courts in respect of human rights violations, by supporting judicial redress of human rights violations by domestic courts, and by fostering a better integration of European human rights standards in selected areas of legislation and domestic policies.
The main project partners : Justice Academy, Judicial Council, Constitutional Court, Bar Association, Agency for Free Legal Aid, Office for Good Governance, Ministry of Justice and civil society organisations
Expected results: The project promotes a holistic approach to human rights protection. It will seek convergence among relevant authorities and all actors along the justice chain, relying on three areas of action:
1. Improving the quality of applications lodged with courts in respect of human rights violations, by developing relevant tools and ensuring adequate training of legal professionals.
2. Supporting judicial redress of human rights violations by domestic courts, by developing the professional capacities and knowledge of judges and prosecutors at all levels regarding case law of the European Court of Human Rights and of the Constitutional Court, and by facilitating the establishment of research and case law units within courts wherever possible.
3. Fostering the implementation of European human rights standards by facilitating joint analysis by legislative, executive and judicial branches, and by developing the capacities within the Office for Good Governance within the Prime Minister’s Office and/or within the Ministry of Justice in the field of European human rights standards.
Key Activities
- Advocacy and advisory support in the drafting and review of relevant legislation and policies
- Development of knowledge systems within the Constitutional Court and support to the establishment of research units within other relevant domestic courts
- Thematic workshops on European Convention standards, European Court case law, and their practical application
- Training and e-learning activities for judges, prosecutors and lawyers on European Convention standards
- Round table discussions with courts at all levels to address key topics emerging from judicial practice
- International exchange with peer institutions, through conferences, study visits and opportunities for placements.
